The Client's Challenge

The subject product was a pen-type digital multimeter designed for conventional electrical measurements such as automatic ranging, voltage measurement, diode testing and continuity testing. It also incorporated a black-and-white display, audible alert functionality and AAA-battery operation. More importantly, the product included automotive measurement capabilities for applications such as ignition-coil testing, tachometer measurement and dwell-angle measurement.

The client sought a U.S.-focused Freedom to Operate search to identify patent and patent-application claims potentially relevant to the commercialization of this product. Rather than treating the multimeter as a single generic technology, the investigation decomposed the product into its individual functional elements and examined how those elements appeared across the patent landscape.

The following product features and search requirements were considered:

    • Pen-type digital multimeter configuration
    • Automatic range selection for electrical measurements
    • Voltage measurement functionality
    • Diode testing capability
    • Continuity testing with audible indication
    • Black-and-white display for measurement results
    • AAA-battery powered operation
    • Automotive measurement functions

CLIENT’S OBJECTIVE

Focus exclusively on the U.S. jurisdiction to assess potential patent-related risks associated with commercialization in the U.S. market.

Distinguish complete claim alignment from technically similar references containing additional claim elements not present in the subject product.

Identify and prioritize the most relevant patent references for subsequent technical and legal FTO assessment.

Clients come to us for answers.

They leave with opportunities they didn’t know existed.

Wissen’s Out-of-the-Box Approach:

From Generic Multimeter Searching to Feature-Level Patent Intelligence

  • Recognizing that conventional searches were producing a large number of broadly similar pen-type digital multimeter references, the investigation evolved beyond a single product-level search strategy.
  • Rather than treating the digital multimeter as one consolidated technology, the product was decomposed into its individual functional elements to determine which features were most likely to create meaningful patent intersections.

Identifying Relevant Patent Spaces

  • A focused analysis was conducted across the pen-type digital multimeter landscape to identify companies and assignees actively developing and patenting related technologies.

  • This feature-level approach enabled the investigation to move from a broad population of technically similar references toward a more focused set of patents and patent applications with stronger alignment to the actual product functionality.

Our Methodology

Traditional Search Limitations
Product Feature Decomposition
Feature-Specific Patent Searching
Assignee & Inventor Intelligence
Claim-Level Screening
FTO Reference Categorization
Traditional Search Limitations

• Broad searches generate numerous similar multimeter references
• Many references contain additional claimed elements
• Known references do not necessarily disclose automotive functions
• Product-level similarity does not establish claim-level relevance

Product Feature Decomposition

• Break down the product into individual technical features
• Separate conventional measurement functions from automotive applications
• Identify features requiring dedicated search strategies

Feature-Specific Patent Searching
  • Develop keyword and synonym combinations for each feature
  •  Incorporate relevant IPC/CPC classifications
  • Conduct dedicated searches for ignition-coil, tachometer and dwell-angle functions
Assignee & Inventor Intelligence

• Identify leading assignees within the pen-type multimeter space
• Analyze relevant patent portfolios
• Combine assignee searches with technical classifications and product features

Claim-Level Screening

• Review identified patent and patent-application claims
• Compare independent claims against the defined product features
• Distinguish complete feature alignment from references

FTO Reference Categorization
  • Identify references aligning with the complete evaluated feature set
  • Classify closely related references separately
  • Establish a structured evidence base for subsequent FTO assessment
Outcome:

A feature-driven U.S. FTO search identified eight patent or patent-application references whose independent claims aligned with the evaluated product features under the search criteria.

FTO Search Methodology

The investigation was conducted to identify U.S. patents and patent applications potentially relevant to the evaluated pen-type digital multimeter and its associated electrical and automotive measurement functions.

The investigation involved:

The search was limited to publicly available patent information within the U.S. jurisdiction. Identified references were evaluated based on their disclosed claim elements and their relationship to the technical features of the subject product.

The resulting analysis was intended to provide a structured technical evidence base for subsequent FTO assessment and legal review.

Technical Challenges Addressed Through Feature-Level FTO Analysis

Challenge 1: Distinguishing Complete Product Alignment from Broadly Similar Multimeter Patents

A key technical challenge involved determining whether patents describing pen-type digital multimeters actually covered the complete combination of features implemented in the subject product.

Solution

The identified patent references were examined at the independent-claim level and compared against the product’s defined technical features. The analysis revealed that several references described highly similar pen-type multimeter configurations but included additional claim elements not present in the subject product.

The analysis revealed:
  • Automatic ranging and voltage measurement functionality
  • Diode and continuity testing capabilities
  • Display and audible alert functionality
  • AAA-battery-powered operation
  • Additional claimed elements present in certain references

This claim-level comparison enabled the search team to distinguish references with complete feature alignment from technically similar references containing additional limitations.

Challenge 2: Identifying Patent Coverage for Specialized Automotive Measurement Functions

Another important challenge involved determining whether the automotive measurement capabilities of the product were disclosed or claimed within the identified patent landscape.

Solution

A dedicated search strategy was developed specifically around the automotive measurement applications of the product. Relevant keywords, synonyms and IPC/CPC classifications were combined with targeted patent searches to identify references addressing these specialized functions.

The analysis revealed:
  • Ignition-coil testing functionality
  • Tachometer measurement functionality
  • Dwell-angle measurement functionality
  • Patent activity specifically associated with automotive measurement applications

These findings helped isolate the narrower automotive patent space from the broader digital multimeter landscape and provided additional insight into the features that differentiated the subject product.

Results & Business Impact

The final investigation successfully identified a focused set of U.S. patent and patent-application references relevant to the subject pen-type digital multimeter through a feature-level FTO search strategy.
